Fences, Gates & Walls in San Marcos

Modern Fence & Deck builds aluminum and steel fences, manual side, pedestrian and pool gates, block and gabion walls, and steel pipe-rail horse fencing for San Marcos homes, from San Elijo Hills slopes to agricultural-zone acreage. San Marcos is the next city west of Escondido, where our fabrication shop sits on Venture St. Each fence is planned to the City's own code, summarized below.

Fence rules in San Marcos

The City's Walls and Fences chapter (SMMC 20.335, last amended in 2017) sets the height limits; Building and Fire documents set the rest. Each line links its source.

  • Front yard42 in

Fences and walls in a single-family front setback stop at 42 in. On a corner lot the street side stays at 42 in inside the front setback area and may reach 6 ft beyond it. Height runs from finished grade to the top of the fence.

  • Side and rear6 ft

Side, interior and rear property lines allow 6 ft. More height takes a Director's Permit, which the City weighs against the neighbors and the need.

    Source: SMMC §§ 20.335.050.A.3, 20.335.030.F.2, as of October 2026
  • Building permitOver 7 ft

We found no local change to the fence exemption in the City's amendments to the 2025 building code, and the fee schedule lists building plan check for “fences over 7 feet.” Confirm a tall fence with the Building Division.

  • Retaining wallsCity detail to 6 ft

The Building Division's standard block retaining wall covers walls up to 6 ft that carry no surcharge from vehicles or other structures; other designs need an engineered analysis. We found no local permit threshold, so confirm one with the Building Division (760-744-1050 ext. 3244).

  • Pool barrier60 in, plus a property fence

On top of the two drowning-prevention features state law requires, the City's pool handout calls for a property fence built to the enclosure standard: at least 60 in, gates that open away from the pool and self-close, and a latch no lower than 60 in.

  • Fire · Zone 0A local Zone 0 rule

For buildings in or next to a hazardous fire area, the WUI code the City and its fire district adopted (effective January 1, 2026) requires the first 5 ft to be continuous hardscape or noncombustible materials, and its Zone 0 figure says to remove combustible “fences attachments.” It doesn't say whether existing homes must retrofit, so ask SMFD Fire Prevention (760-744-1050 ext. 3400). The state's Zone 0 package was withdrawn from review on September 8, 2026 and is not in effect.

Hedges may not grow taller than the wall limit, and no fence may block intersection sight lines (SMMC § 20.335.030). This is planning information; the City decides what a project needs.

Why San Marcos is different

What Shapes a San Marcos Fence

01 · Acreage

Agricultural zones allow more

On Agricultural (A) zone lots of one gross acre or more, open front fences of wrought iron, tubular steel, pipe corral or rails may reach 60 in if they are 90% open, with posts no taller than 66 in. Single-family zones keep the 42-in front limit (SMMC § 20.335.060).

02 · Ridgelines

The Ridgeline Overlay

Double Peak and Cerro de Las Posas sit in a zoning overlay, not a fire designation. Inside it, wrought iron or dark green or black vinyl-clad chain link is allowed, galvanized chain link with slats isn't, and retaining walls over 8 ft are terraced and planted; view fences up to 6 ft and many existing homes are exempt (SMMC §§ 20.260.030, 20.260.050).

03 · Street edge

Walls that face a street

A blank wall within 10 ft of a public right-of-way needs planting at least 42 in tall between wall and street; wrought iron is excluded. Chain link isn't allowed along any public right-of-way, whatever the setback (SMMC § 20.335.030).

Common questions

San Marcos Fence Questions

My mailing address says San Marcos. Do these rules apply?

Only inside city limits. Some San Marcos mailing addresses are on unincorporated County land, where County fence rules apply instead. The City's Zoning Portal has the zoning map, and Planning can confirm which side of the line a parcel is on.

Can I use barbed wire or an electric strand to keep horses in?

Only in Agricultural (A) zones, and only where it's needed to secure livestock or horses; there, woven, barbed or electrified wire may be permitted in front and side yards up to 72 in. Elsewhere in the city, barbed, razor, concertina and electrified wire are prohibited (SMMC § 20.335.030.E).

Does the City accept aluminum and steel fences?

The code's approved-materials list names wood, vinyl, stone, masonry, brick, block, stucco, wrought iron and concrete; aluminum and steel aren't named. A fence also has to suit the architecture of the house, so ask Planning early how a modern metal design will be classified (SMMC § 20.335.030).

Does a pool plan need to show the neighbor's side of the line?

Close to it, yes. The City's 2026 pool and spa plan requirements ask for climbable structures within 5 ft of the property line on adjacent properties, along with the barrier, fence and gate locations.
